TERMS OF AGREEMENT

 

 

Fees

The Law Office of Michael D. Sheehan charges a flat fee for traffic infractions in King, Pierce, and Snohomish counties as follows: Single Infraction-No Accident Involved ($300), Single Infraction in School Zone No Accident ($350), Single Infraction-Accident Involved ($400), Negligent Driving ($500).  For all other situations: (e.g. criminal traffic offenses, multiple infractions listed on the ticket, traffic infractions outside of King, Pierce or Snohomish counties), the prospective client is required to contact Mr. Sheehan by phone or email to discuss the appropriate fee.

 

Full and correct payment is required at the beginning of representation.  I understand that the Law Office of Michael D. Sheehan will not begin representation or work on my case until/unless I have paid the flat fee described above in full.

 

In the event that you have submitted an incorrect fee, it understood that the Law Office of Michael D. Sheehan has not agreed to represent you. The correct fee must be submitted in full before we can agree to represent you or start work on your case. 

 

Guarantee of Performance

I understand that this agreement is for Mr. Michael D. Sheehan along with his designated associates to be available to represent client in exchange for compensation as set forth herein.

 

The primary goal of this representation is to prevent my infraction(s) from appearing on my driving record ("Washington State Department of Licensing Driver's Abstract.").  However, it is understood that there is no guarantee of obtaining a dismissal or otherwise keeping the ticket off client’s record.  Further, I authorize Mr. Sheehan to use designated associates at contested hearings.

 

I specifically authorize the Law Office of Michael D. Sheehan to obtain a deferred finding on my behalf only if there is no other possible way of obtaining a not-committed finding, dismissal, or amendment to a violation that will not appear on my driving record

 

Client will authorize Mr. Sheehan and his designated associates to resolve said traffic matter in a manner deemed to be in client's best interests

 

Liability

I agree that your liability is limited to the amount that I pay your office to represent me on my ticket. I agree that I will not be entitled to damages beyond that amount regardless of outcome or result.  If a lawsuit is initiated as a result of our business relationship, I agree that jurisdiction and venue will be in King County District Court.

 

Legal Disclaimers

Upon receipt of the flat fee, the funds are the property of the Law Office of Michael D. Sheehan and will not be placed in a trust account.  The fact that you have paid the fee in advance does not affect your right to terminate the client-lawyer relationship. In the event our relationship is terminated before the agreed-upon legal services have been completed, you may or may not have a right to a refund of a portion of the fee. As required by the Washington State Bar Association, attorney Sheehan hereby gives notice that the malpractice insurance coverage maintained by attorney Sheehan does not meet the levels recommended by the bar association ($100,00 per occurrence and $300,00 in the aggregate).  Client hereby gives informed consent to representation by attorney Sheehan nevertheless.
